Florida E-Bike Bill Aims to Change Regulations

A recently filed bill in Florida (SB 1234) proposes changes to how the state regulates high-speed electric bicycles (e-bikes). If passed, this legislation will impact both riders and retailers.

Current Florida E-Bike Regulations

Under current Florida law, e-bikes are classified into three categories based on their top speed and motor power:

  • Class 1: pedal-assist e-bikes with a maximum speed of 20 mph
  • Class 2: throttle-assisted e-bikes with a maximum speed of 20 mph
  • Class 3: pedal-assist e-bikes with a maximum speed of 28 mph

E-bikes in Classes 1 and 2 are treated similarly to traditional bicycles, requiring no license, registration, or insurance. Class 3 e-bikes, however, currently require riders to be at least 16 years old and wear a helmet. Moreover, retailers selling Class 3 e-bikes must register them with the Florida Department of Highway Safety and Motor Vehicles (FLHSMV).

Proposed Changes to Florida E-Bike Laws

The new bill seeks to:

  • Create a new classification for high-speed electric bicycles, defined as e-bikes capable of reaching speeds over 30 mph
  • Require riders of high-speed electric bicycles to obtain a license, register their e-bikes with the FLHSMV, and carry insurance
  • Update the driver's licensing test to include information on sharing the road safely with high-speed electric bicycles
