1. Agreement to Terms

By accessing or using EVRoutes ("Service"), operated by EVRoutes ("Company", "we", "us", or "our"), you agree to be bound by these Terms, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to update and change these Terms at any time without notice.

2. Use License and Restrictions

2.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

2.2 License Restrictions

You may not:

• Copy, modify, or distribute the Service or its content
• Use the Service for commercial purposes without our written permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove, alter, or obscure any proprietary notices
• Use automated systems or software to extract data from the Service (scraping)
• Interfere with or disrupt the Service or servers/networks connected to it
• Violate any applicable laws or regulations
• Create derivative works based on the Service
• Transfer, sell, or rent your rights to use the Service

3. Service Description and Modifications

3.1 Service Features

EVRoutes provides electric vehicle route planning services, including but not limited to:

• Route calculation with charging station recommendations
• Vehicle profile management
• Real-time charging station information
• Route optimization based on various factors
• Trip cost estimation
• An MCP (Model Context Protocol) app that exposes the same route planning + charging search to AI assistants such as ChatGPT, Claude, and any other MCP-compatible client

3.2 AI Assistant Integrations

When you use EVRoutes via an AI assistant, these Terms apply to your interactions with our service. The conversation itself is governed by your agreement with the AI host (OpenAI, Anthropic, or other operator). EVRoutes is not responsible for the AI assistant's responses or how the host handles your conversation history. See our Privacy Policy §1.4 for what data is shared during MCP tool calls.

3.3 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

4. User Accounts and Responsibilities

4.1 Account Registration

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use or security breach

4.2 Age Requirements

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

5. User Content and Conduct

5.1 User Content License

By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display such content in connection with the Service.

5.2 Prohibited Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Harass, abuse, or harm another person
• Provide false or misleading information
• Impersonate any person or entity
• Upload viruses or malicious code
• Spam or send unsolicited communications
• Interfere with other users' enjoyment of the Service

The Service and its original content, features, and functionality are and will remain the exclusive property of EVRoutes and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written permission.

Any feedback, suggestions, or ideas you provide about the Service becomes our property and may be used without compensation or attribution to you.

7. Third-Party Services and Content

Our Service may contain links to third-party websites, services, or content that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services.

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content or services.

8. Disclaimers and Limitations of Liability

8.1 Educational Purpose and Route Planning Disclaimer

The route suggestions, charging recommendations, and all calculations provided by EVRoutes are estimates based on theoretical models and third-party data. Actual results will vary based on numerous factors including but not limited to:

• Actual driving conditions and driving style
• Weather conditions and temperature
• Vehicle condition and actual battery performance
• Traffic conditions and route deviations
• Charging station availability and operational status
• Elevation changes and terrain
• Vehicle load and passenger weight
• Use of climate control and other accessories

Users are solely responsible for ensuring they have adequate range, backup plans, and emergency provisions for their journeys. Always consult your vehicle's built-in navigation system and manufacturer recommendations.

8.2 Service "As Is"

8.3 No Guarantee of Accuracy

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• The quality of the Service will meet your expectations
• Any errors in the Service will be corrected
• Charging station information is current or accurate
• Route calculations will reflect actual driving conditions

8.4 Limitation of Liability

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you have paid us in the past twelve (12) months, or one hundred dollars ($100), whichever is greater.

9. Indemnification

You agree to defend, indemnify, and hold harmless EVRoutes and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Request by law enforcement or government agency
• Discontinuance or material modification of the Service
• Unexpected technical issues or problems
• Extended periods of inactivity

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive.

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, each party agrees to try to resolve the dispute informally by contacting the other party.

11.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute arising from these Terms or the Service shall be resolved through binding arbitration, except that each party retains the right to seek injunctive or other equitable relief.

11.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which EVRoutes is registered, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Service and informs users of our data collection practices.

14. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, pandemic, governmental action, war, terrorism, or other unforeseeable cause beyond our reasonable control.

15. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and EVRoutes concerning the Service.

17. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Service or by other means. Your continued use of the Service after such notice constitutes acceptance of the modified Terms.

18. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights under these Terms without your consent.
